Yaşam hakkı, uluslararası anlaşmalarla tanınan ve
Anayasamızda güvence altına alınan temel haklar arasında yer almaktadır. Bu
hak, diğer tüm hak ve özgürlüklerin kullanılabilmesinin ön şartı olarak
değerlendirilebilir. Bu temel hakkın korunmasında Anayasamız devlete pozitif ve
negatif yükümlülükler yüklemektedir. Devlet (idare), bu yükümlülüklerini,
kolluk kuvvetleri vasıtasıyla yerine getirmektedir.
Her ne kadar yaşam hakkı
Anayasada “herkes” için güvence altına alınmış ise de istatistiksel veriler,
kadınların toplumsal cinsiyet algısı nedeniyle sadece kadın oldukları için
yaşam hakkı ihlallerine daha fazla maruz kaldıklarını göstermektedir.
Anayasamızın 10. maddesinin 2. fıkrasına 2010 yılında getirilen ek cümle
gereğince, idarenin özelde kadının yaşam hakkını korumak için ek tedbirler
alması eşitlik ilkesine aykırı görülemez. Bu çerçevede 6284 Sayılı Ailenin
Korunması ve Kadına Yönelik Şiddetin Önlenmesi Hakkında Kanun, yaşam hakkı
ihlali tehdidi altında olduğu iddiasıyla kolluk kuvvetlerine başvuran kadının
bu başvurusunun, zaman kaybedilmeden ilgili makamlara iletilmesi ve gereken
tedbirlerin alınması zorunlu tutulmuştur. İlgili kolluk görevlisinin bu şekilde
kendisine yapılan bir başvuruyu ilgili birimlere bildirmemesi (işlem yapmaması)
sonucunda kadının yaşam hakkı ihlal edildiğinde, idarenin, kolluk kamu
hizmetini gereği gibi yerine getirmemesi nedeniyle kusur sorumluluğu
doğmaktadır. Bunun yanında ilgili kolluk görevlisinin de hem idari, hem de
dolaylı da olsa tazminat sorumluluğu doğmaktadır.
Bu çalışmada, usulüne göre kabul edilmiş uluslararası anlaşmalar, 1982 Anayasasındaki hükümler ve 6284 Sayılı Kanun çerçevesinde, kolluk görevlisinin yükümlülüklerini yerine getirmemesi sonucunda kadının yaşam hakkının ihlal edilmesi durumunda hem idarenin hem ilgili kolluk görevlisinin yükümlülükleri ve sorumlulukları incelenecektir. Bunun yanında kadının yaşam hakkının korunması hususunda mevzuatta eksik görülen hususlar incelenecek ve çözüm önerileri getirilecektir.

The right to life is among the fundamental rights recognized by
international agreements and guaranteed by our Constitution. This right can be
considered as a prerequisite for exercising all other rights and freedoms. In
the protection of this fundamental right, our Constitution imposes positive and
negative obligations on the state. The state (administration) fulfills these
obligations through law enforcement.
Although the right to life is guaranteed for “everyone” in the
Constitution, statistical data show that women are more exposed to violations
of the right to life just because they are women due to their gender
perception. Pursuant to the additional sentence introduced in the second
paragraph of Article 10 of our Constitution in 2010, it cannot be seen as
contrary to the principle of equality that the administration takes additional
measures to protect the right to life of women in particular. In this context, in
Law No. 6284 on Protection of Family and Prevention of Violence Against Women,
is obliged to forward this application to the relevant authorities without
delay and to take the necessary measures for application of the woman, who
applied to law enforcement authorities with the allegation that she was under
the threat of a violation of her right to life. As a result of failure of the
relevant law enforcement officer to notify the relevant units of an application
made in this way (failure to act), when a woman's right to life is violated, due
to the failure of the administration to perform the law enforcement public
service properly, liability for fault arises. In addition, the relevant law
enforcement officer is also liable for compensation, both administratively and
indirectly.
In this paper, within the framework of duly accepted international agreements, provisions of the 1982 Constitution and Law No. 6284, in the event that a woman's right to life is violated as a result of the law enforcement officer's failure to fulfill her obligations, the obligations and responsibilities of both the administration and the relevant law enforcement officer will be examined. In addition, the deficiencies in the legislation regarding the protection of women's right to life will be examined and solutions will be offered.
