Adil Yargılanma Hakkının Bir Unsuru Olarak Sanığın Duruşmada Hazır Bulunma Hakkı

Özet
Adil yargılanma hakkının ele alındığı Avrupa İnsan Hakları Sözleşmesi’nin 6. maddesinde sanığın duruşmada hazır
bulunma hakkının doğrudan düzenlenmediği ancak dolaylı bir şekilde ifade edildiği düşünülmektedir. Kendisine suç isnat
edilen kişinin savunmasını bizzat yapması, evrensel bir haktır. Kişinin kendisini bizzat savunabilmesi için öncelikle duruşmada
hazır bulunması gerekmektedir. Duruşmada hazır bulunma hakkı, adalet mekanizmasının demokratik denetimine,
tarafların yargılamaya söz, jest ve mimiklerle etkin ve verimli olarak katılmalarına olanak veren çok işlevli bir buluştur.
Kişinin geleceğini belirleyen bir kararın oluşturulma sürecine katılmasında, kendisi için çok önemli olan bir davayı izleyebilmesinde
açık menfaati bulunmaktadır. Adil yargılanma hakkının dolaylı olarak ürettiği bu hak, yargılamada saydamlığı
temine yönelik olmasının yanı sıra alındığı Avrupa İnsan Hakları Sözleşmesi m.6/3’teki teminatların da gerçekleşmesine
olanak sağlar. Benzer bir düzenlemeyi içeren 5271 sayılı Ceza Muhakemesi Kanunu m.193 uyarınca sanığın hazır bulunması
duruşma yapılması için esastır. “Yüze karşılık” ilkesinin bir sonucu olarak sanığın ve avukatının duruşmalara
katılımı, savunma hakkının etkin kullanımı açısından alternatifi olmayan bir haktır.
It has been agreed that the right of the accused to appear in person before the court is not directly specified in Article 6 of
the European Convention on Human Rights concerning the right to a fair trial; however, this right is stipulated indirectly.
The right of the accused to appear in person before the court is the fundamental element of the right to a fair trial. The
alleged person has the right to defend himself/herself in person. The accused should have the opportunity to appear
before the court to be able to make a self-defense. The right to appear in person before the court is a multi-functional
invention that allows the democratic audition of the judicial administration, the participation of the judiciary and the concerned
parties to the trial, and the effective and efficient participation of the judiciary to the trial with words, gestures, and
mimics. It should be agreed upon that there is an explicit interest in participation to the process of making a judgment that
will determine the destiny of a person and pursuing a case that has paramount importance for the person. This right, which
has been indirectly built upon the right to a fair trial, both contributes to transparency and focuses on ensuring the securities
listed in Article 6/3 of the European Convention on Human Rights. In accordance with the Article 193 of the Criminal
Procedure Code No. 5271, which involves a similar regulation, the presence of the accused is essential for the proceeding
of the trial. As a consequence of the principle of “direct effect”, the presence of the accused and his/her attorney at the
trials is an indispensable right for effective exercise of the right to defense.
