Özet

5271 sayılı Ceza Muhakemesi Kanunu’nun 134. maddesine göre bilgisayar, bilgisayar programları ile kütükleri hakkında el koy- ma tedbiri uygulanabilir. Bu tedbir CMK’nin 123. maddesinde düzen- lenen basit el koyma tedbirinin özel bir türüdür. CMK’nin 141. madde- sinde ise koruma tedbirleri nedeniyle devlete karşı açılabilecek taz- minat sebepleri tahdidi olarak sayılmıştır. Bunlar arasında “eşyasına veya diğer malvarlığı değerlerine, koşulları oluşmadığı halde elkonu- lan veya korunması için gerekli tedbirler alınmayan ya da eşyası veya diğer malvarlığı değerleri amaç dışı kullanılan veya zamanında geri verilmeyen” kimselerin her türlü maddi ve manevi zararlarını devlet- ten isteyebileceği yönündeki sebep zikredilmiştir. Çalışmada ilk olarak basit el koyma ile bilgisayar, bilgisayar programları ve kütükleri hakkındaki el koyma hükümlerine değinile- cektir. Ardından CMK’nin 141/1-j bendinde yazılı tazminat sebebi “bi- lişim sistemleri” özelinde incelenecektir. Açılan davalardaki maddi ve manevi tazminat taleplerinde hangi kalemlerin değerlendirilmesi gerektiği çeşitli yargı kararları ışığında ele alınacaktır. Nihayetinde Avrupa İnsan Hakları Mahkemesi’nin konuya yaklaşımı ile beraber birtakım değerlendirmelerde ve çözüm önerilerinde bulunulacaktır.
Pursuant to Article 134 of the Turkish Criminal Pro- cedure Code (Law No. 5271), a seizure measure may be imposed on computers, computer programs, and data logs. This measure consti- tutes a specific form of the general seizure measure regulated under Article 123 of the CPC. Article 141 of the CPC exhaustively enumer- ates the grounds on which individuals may bring claims for compen- sation against the State due to protective measures. Among these grounds is the provision allowing individuals whose property or other assets have been seized without the necessary conditions be- ing met, or whose property has not been safeguarded through the requisite measures, or has been used for purposes beyond those prescribed, or has not been returned in a timely manner, to seek compensation from the State for all pecuniary and non-pecuniary damages they have suffered. This study first addresses the general framework of basic sei- zure and the specific rules governing the seizure of computers, com- puter programs, and data logs. It then examines the compensation ground set forth in Article 141/1-j of the CPC, with a particular focus on “information systems.” The components to be taken into ac- count in the assessment of pecuniary and non-pecuniary damages in actions brought against the State will be analyzed in light of various judicial decisions. Finally, the study evaluates the approach of the European Court of Human Rights and offers several observations and proposed solutions.
