Demokratikleşme süreci siyasal iktidarın ve egemenliğin ulusal ve uluslararası arenadaki
dinamiklere bağlı olarak halka aktarılma sürecini ifade eden kapsayıcı bir kavram olarak
algılanabilir. Bu süreç, literatürde de genellikle ele alındığı gibi iki temel adımdan oluşmaktadır: rejim değişikliği ve demokrasinin konsolidasyonu. İlk adım, otoriteryanizmden demokratik rejime geçiş sürecini ihtiva ederken, ikincisi ise demokratik değerlerin toplum ve devlet nezdinde içselleştirilmesini ifade etmektedir. Bu bağlamda, günümüzde demokratik rejimlerin demokratikleşmesi süreci tarihsel perspektifle ele alındığında, bu değişimlerin genellikle ülke içinde ya da dışında gerçekleşen darbe, ihtilal, savaş vb. gibi dramatik değişimler sonucunda gerçekleştiği ifade edilebilir. Öte yandan bu ülkelerde gözlenen diğer bir olgu ise demokrasiye geçiş sonrası siyasal hayatın hukukun üstünlüğü, siyasal muhalefetin oluşması, serbestçe işleyen basın ve yayın organlarının tahsisi ve siyasal katılımı arttıran mekanizmaların yaygınlaştırılması gibi demokrasinin evrensel değerleri üzerine yapılandırıldığıdır. Bu bağlamda demokratikleşme sürecini etkileyen birçok faktörün yanında anayasal hareketlerin, geçmişten günümüze rejimlerin değiştirilmesinde ve demokrasinin konsolidasyonunda önemli roller üstlendiği belirtilebilir. Bu açıdan, 19.yy’den itibaren başlayan anayasal hareketlerin Türkiye’nin siyasal, toplumsal ve ekonomik yapısını derinden etkilediği mevzusundaki genel kanı, 2017 yılında gerçekleştirilen 1982 Anayasası’ndaki 18 maddelik değişimi, demokratikleşme bağlamında analiz edilmesini cazip hale getirmektedir. Bu bildirinin temel çıkış noktası ise 2017 yılında değiştirilen maddelerin, kuvvetler ayrılığı ilkesinin güçlendirilmesi, yasama-yürütme erklerinin dengelenmesi, demokrasinin üzerindeki vesayetin kaldırılması, temel hak ve özgürlüklerin genişletilmesi ve hukukun üstünlüğü anlayışının pekiştirilmesi bağlamlarında Türkiye’deki demokratikleşme süreçlerine pozitif yönde bir etkide bulunduğu yönündeki iddiaya dayanmaktadır. Bu minvalde çalışmanın temel amacı, Anayasa’daki bu değişikliklerin Türkiye’deki demokratikleşme sürecine etkilerini evrensel demokratik değerleri dikkate alarak ayrıntılı bir şekilde analiz etmeyi ve bu süreçlere katkılarını ve götürülerini ortaya koymayı amaçlamaktadır.
The democratization process can be perceived as an inclusive concept which means transferring of
political power and sovereignty to the public depending on dynamics in the national and international arena. This process that is usually addressed in literature consists of two basic steps: including
changing of the regime and consolidating democracy. While the first one includes the process of transition
from authoritarianism to democracy, the second one expresses the internalization of democratic
values in the presence of society and state. In this context, when the democratization process of
democratic regimes is taken into consideration with a historical perspective, it can be expressed that
these changes are usually carried out as a result of dramatic changes within the country or abroad,
such as a coup, revolution, war, etc. On the other hand, another phenomenon observed in these
countries is that after the transition to democracy, political life is structured on the universal values
of democracy such as the rule of law, the formation of political opposition, the allocation of freely
functioning press and media organs and the dissemination of mechanisms that increase political
participation.
In this context, besides the many factors affecting the democratization process, it can be stated that
constitutional movements have assumed important roles in the changing of regimes and
consolidation of democracy from past to present. In this respect, general opinion on the topic that
the constitutional movements that began in the 19th century deeply has affected Turkey’s political, social
and economic structure make attractive the alteration of 18-items in 1982 Constitutions held in 2017
to be analyzed in the context of democratization. The basic starting point of this paper rests on
claim to articles changed in 2017 have positive effects on Turkey’s democratization processes in the
context of strengthening the principle of separation of powers, balancing legislative-executive
powers, abolishing tutelage on democracy, broadening fundamental rights and freedoms and
reinforcing the understanding of the rule of law. In this manner, the basic objective of the study is to
analyze in detail the impact of these changes on the democratization process in Turkey, taking into
account the universal values of democracy and the constitution aim to put forward contributions
and disadvantages of these processes
