An employment contract subject to a probationary period is a particular form of employment relationship that permits the parties, during the probationary period, to terminate the contract without being subject to notice requirements or the corresponding compensation obligations. The primary function of the probationary period is to enable both parties to assess the suitability and sustainability of the employment relationship at its initial stage. Nevertheless, the continuation of the employee’s legal status and employment-related rights throughout the probationary period raises the question of whether, and to what extent, trade union rights and protections apply during this period. This paper examines the exercise of trade union rights by employees subject to a probationary period and the legal position of such rights vis-à-vis the employer’s power of termination. The study first addresses the employee’s right to join a trade union, participate in trade union activities, benefit from a collective agreement, and exercise the right to strike during the probationary period. Since the employee retains their status as an employee throughout the probationary period, the mere existence of such a period cannot, in itself, constitute a legal ground for restricting or excluding the exercise of trade union rights. Accordingly, probationary status should not be construed as creating a legal sphere in which employees are deprived of the protection afforded to trade union rights. A further issue examined is whether an employee who is elected as a workplace trade union representative or appointed as an officer of a workers’ organisation during the probationary period may benefit from the statutory protections applicable to such positions. In this context, the paper analyses the interaction between the employer’s simplified termination power during the probationary period and the trade union protections provided under Law No. 6356 on Trade Unions and Collective Labour Agreements. In light of Article 51 of the Turkish Constitution, which guarantees freedom of association and the right to form and join trade unions, the study argues that the probationary period cannot be interpreted in a manner that renders trade union rights and the statutory safeguards attached to them ineffective
