Özet

The Importance of Secondary Examination in Preparing a Final Report: Differentiation between Old Fracture and New Fracture-Case Report General İnformation In the 3rd paragraph of Article 87 of the Turkish Penal Code, it is stated that "If intentional injury causes a bone fracture in the body, a prison sentence of one to six years is imposed, depending on the effect of the fracture on life functions." The effect of bone fracture on vital functions is also an issue that should not be ignored when preparing a report. While the presence and scoring of bone fractures are performed, the person's previous injuries and whether bone fractures occurred in these injuries are important for the forensic report to be prepared. This study evaluates bone fractures, which is one of the issues considered when preparing a final report in Forensic Sciences, and the approach to the distinction between old fractures and new fractures encountered in practice. Case Two cases sent to us by the court to prepare a final report regarding their traumatic injuries were evaluated in our polyclinic. When the injuries of the individuals were examined, it was determined that both cases had bone fractures, and when the anamnesis and hospital records were evaluated together, it was determined that they had previously had traumatic injuries and related bone fractures in the same areas. Conclusion In traumatic forensic cases, evaluating the person only with the latest findings may lead to irreparable errors in the future. The case should be considered as a whole, the wounds, the person's anamnesis, the first general forensic examination report, and the medical records before and after should be evaluated as a whole with a multidisciplinary approach.
