Özet
Gizli tanığın ceza yargılamasında kullanılması hukuk devletinin vazgeçilmezi olan adil yargılanma hakkını tehlikeye sokmaktadır. Zira gizli tanıklık duruşmanın aleniliği ilkesine ters bir uygulamadır. Bu nedenle tanığın ciddi bir tehlike altında bulunduğu durumlar ile sınırlı olarak uygulanması kabul edilebilir. Bu durumda dahi gizli tanık beyanı hüküm açısından tek ve belirleyici delil olmamalıdır. Başka deliller ile hüküm desteklenmelidir. Aksi bir düşünce tarzı, tanığın korunması adına adil yargılanma hakkının feda edilmesi anlamına gelir. Bu makalede, ceza muhakemesi alanında çözümlenmemiş bir sorun olarak varlığını sürdüren gizli tanık beyanın delil değeri, konuya ilişkin Avrupa İnsan Hakları Mahkemesi kararları çerçevesinde incelenmiştir.
The application of the anonymous witness in criminal proceedings jeopardizes the right to a fair trial, which is an indispensable part of the rule of law. Because, witness anonymity is an application contrary to the principle of public hearing. It is therefore acceptable to apply it limited to situations in which the witness is in serious danger. Even in this case, the statement of a anonymous witness should not be the only and decisive evidence in terms of the judgment. The judgment must be supported by other evidence. To think otherwise means sacrificing the right to a fair trial for the protection of the witness. In this article, the practice of anonymous witnesses, which continues to exist as an unresolved problem in criminal procedure, has been evaluated within the scope of the decisions of the European Court of Human Rights.
